OUR DEBT RECOVERY PROCESS

At Qeeva Advisory Limited, we implement the following six debt recovery process in providing third party debt collection services:

  • STEP ONE

The first step we take is to make phone calls or write letters professionally and ethically to the debtors. And if after making a written notification to the debtor, there is no positivity, we will then proceed to informing our clients

  • STEP TWO

We then proceed to send the claim that has been signed by our clients to our affiliated lawyers and if our lawyers deem it fit to take a legal action, we will proceed to requesting all the documents that will required for the legal action. Some of the documents we require are:

  1. The address of the person owing you (the debtor)
  2. The amount that is owed by the debtors
  3. Span or age of the debt
  4. A copy of the evidences showing the contract agreement, a copy of any acknowledgement email or correspondence from the debtor where he/she/it confirms to undertake the debt and other relevant documents

  • STEP THREE

After the client has approved the legal action and has provided all the relevant documents that we requested for the legal action. The law suit will be prepared and filed. The client will pay for the cost of the legal action

  • STEP FOUR

The client complaint will be served on the debtors and respondent. If the Debtors file in a response, a discovery process will proceed and a trial date for the court will be fixed. In the case where the debtors do not respond, there will be a default judgement by our lawyers

  • STEP FIVE

After we achieve a positive judgement, our lawyers will file a Writ of Attachment or Levy Execution that will aid in locating the debtor’s assets and lay the steps that will bring about judgement through bank levies, garnishee orders, etc.

  • STEP SIX

The final step is to try to adopt an early out settlement by negotiating, mediating, and arbitrating on our client’s behalf in order to get either cash or collateral to avoid an expensive legal option and the time consuming factor. If the re-legal remedies and pre-legal collections falter, we will discuss the next legal actions to take with you

Do you offer Litigation Services if Pre-legal action fails to compel repayment of the debt?

Yes, we do in affiliation with a team of Legal Practitioners who work with us to deliver this service. Gainfully, no fees are paid for Court appearances.

Are collection fees legal to be added to the balance owed for both consumer and or commercial debt?

Yes, if same was incorporated in or contemplated by the Contract. Otherwise a victorious party in a litigation would be entitled only to Costs

Other Conditions?

We will be happy to accept recovery action for debtors in good financial standing and in a position to pay the debt or have assets that can be seized and auctioned in events we have to get them to pay through litigation and they failed to satisfy the judgment debt after mediation failed.
