Introduction

This guide provides an elaborate overview of the regulatory framework for Oil and Gas Industry Service Permits (OGISP) in Nigeria. It is designed for companies, service providers, and investors involved in upstream petroleum operations, offering clarity on requirements, processes, and compliance obligations under current Nigerian petroleum regulations.

Purpose of the Guide

The purpose of this guide is to help industry participants understand the requirements for obtaining and maintaining Oil and Gas Industry Service Permits. It outlines the roles of regulatory authorities, eligibility criteria, permit validity, and scope, providing practical insights to ensure compliance and streamline regulatory interactions.

Role of NUPRC in Upstream Petroleum Regulation

The Nigerian Upstream Petroleum Regulatory Commission (NUPRC) is the primary authority responsible for regulating upstream petroleum activities. Its mandate includes issuing permits, monitoring compliance with industry standards, enforcing safety and environmental regulations, and ensuring that service providers meet technical, operational, and financial criteria before engaging in upstream operations.

Overview of Oil and Gas Industry Service Permits (OGISP)

OGISP is a mandatory regulatory approval for companies providing goods or services to upstream petroleum operators in Nigeria. The permit confirms that the service provider meets the technical, operational, and compliance standards required to operate safely and efficiently in the sector. It also ensures that all upstream contractors are properly registered and accountable under Nigerian law.

Who Requires an OGISP

An OGISP is required for companies offering equipment, technical services, consultancy, or operational support to oil and gas operators in the upstream sector. This includes both local and foreign companies engaged directly or indirectly in upstream petroleum activities. Holding a valid permit is essential before commencing work on any upstream project.

Validity and Scope of Permits

OGISPs are issued for a specified period, typically aligned with the duration of the service contract or operational engagement. The permit defines the scope of services, geographic area of operation, and any conditions attached to compliance, safety, or technical performance. Renewals or extensions are required if the service engagement continues beyond the original validity period.

Statutory and Regulatory Guidelines

Understanding the Statutory and Regulatory Guidelines are essential for compliance with Oil and Gas Industry Service Permit (OGISP) requirements. This framework defines the authority, powers, and responsibilities of regulatory bodies and clarifies how OGISP interacts with other upstream approvals.

Petroleum Industry Act, 2021

The Petroleum Industry Act (PIA), 2021, is the primary legislation governing upstream petroleum operations in Nigeria. It establishes the regulatory regime for oil and gas exploration, production, and related services, including the requirement for service permits. The Act provides the foundation for the issuance, monitoring, and enforcement of OGISPs and other upstream approvals.

Statutory Powers of NUPRC

The Nigerian Upstream Petroleum Regulatory Commission (NUPRC) has statutory authority to:

  • Issue and renew OGISPs for service providers in the upstream sector.
  • Monitor compliance with safety, environmental, and operational standards.
  • Enforce penalties or revoke permits for breaches of regulatory obligations.
  • Approve service providers based on technical, financial, and operational criteria.

Relationship Between OGISP and Other Upstream Approvals

OGISP is one of several approvals required for upstream operations. While it authorises a company to provide services, it must be complemented by other approvals, such as environmental permits, local content compliance certificates, and operator-specific contracts. Holding an OGISP does not replace other statutory or contractual obligations; it is part of a broader compliance framework.

Applicability to Nigerian and Foreign Companies

Both Nigerian-registered and foreign service companies are subject to OGISP requirements if they intend to operate in Nigeria’s upstream sector. Foreign companies must comply with local incorporation or registration rules, provide evidence of technical competence, and demonstrate adherence to Nigerian laws and industry standards before an OGISP is granted.

General Principles Governing Permit Grants

The issuance of Oil and Gas Industry Service Permits (OGISP) is guided by clear regulatory principles designed to ensure that only qualified and compliant companies operate in Nigeria’s upstream sector. Adherence to these principles safeguards operational integrity, promotes safety, and protects national interests.

Eligibility Criteria

Permits are granted only to companies that demonstrate technical competence, financial capacity, and operational readiness to deliver goods or services to upstream operators. Applicants must show a genuine business purpose, proven experience in the sector, and the ability to comply with regulatory, safety, and environmental standards.

Corporate Registration Requirements

Applicants must be duly incorporated or registered in Nigeria, with valid Corporate Affairs Commission (CAC) documentation. Foreign companies must also satisfy local incorporation or registration conditions, providing proof of lawful operation in Nigeria. This ensures that all permit holders are legally recognised entities accountable under Nigerian law.

Annual Validity and Renewal Philosophy

OGISPs are typically valid for one year from the date of issuance. Renewal applications are required for continued operation and are subject to regulatory review. The renewal process evaluates compliance with permit conditions, operational performance, and adherence to reporting obligations, reinforcing continuous accountability.

Prohibition of Forged or Misleading Submissions

Submitting false, forged, or misleading information is strictly prohibited. Regulators assess all documentation for authenticity, and any attempt to misrepresent corporate, technical, or financial credentials can result in immediate permit denial, revocation, or legal action.

Consequences of Non-Compliance and Blacklisting

Non-compliance with permit conditions, submission of false documents, or failure to adhere to safety and operational standards can lead to sanctions, including suspension or revocation of the permit. Repeat or serious violations may result in blacklisting, preventing the company from obtaining future permits and restricting participation in the Nigerian upstream petroleum sector.

GUIDELINES AND REQUIREMENTS FOR THE GRANT OF OIL AND GAS INDUSTRY SERVICE PERMITS (OGISP)

ISSUED BY: NIGERIAN UPSTREAM PETROLEUM REGULATORY COMMISSION 2023

Processing of Applications

The processing of Oil and Gas Industry Service Permit (OGISP) applications involves structured steps to ensure regulatory compliance and verification of all submitted information. Companies must understand the workflow to manage expectations and plan operational timelines effectively.

Desktop Review Process

Upon submission, applications undergo a desktop review by NUPRC officials. During this stage, documents are checked for completeness, authenticity, and alignment with statutory and sector-specific requirements. The review ensures that only compliant applications proceed to the next stage.

Processing Timelines by Permit Category

Processing timelines vary depending on the permit category and complexity of the services offered. Standard service permits may be processed faster, while specialised or high-risk operations, such as offshore or technical services, may require extended review periods. Companies should plan submissions accordingly.

Requests for Additional Information

Where information is incomplete, unclear, or requires verification, NUPRC may request additional documents or clarifications. Companies are expected to respond promptly to avoid delays in the review process. Failure to provide requested information can result in rejection or prolonged processing.

Application Return and Resubmission

Applications that do not meet regulatory standards may be returned for correction and resubmission. Companies should review feedback carefully, update documents accurately, and resubmit through the portal. Resubmissions must adhere to the original application guidelines.

Permit Issuance and Download

Once approved, the OGISP is issued electronically through the portal. Companies can download the permit for operational use and record-keeping. The permit specifies the validity period, scope of services, and any conditions or restrictions imposed by NUPRC. Companies must ensure that the permit is readily available for verification by upstream operators or regulatory authorities.

Change of Service and Permit Modification

Companies may need to modify their Oil and Gas Industry Service Permit (OGISP) to reflect changes in the scope of services, operational requirements, or organisational structure. Permit modifications are regulated to maintain accuracy and accountability in upstream service delivery.

Scope of Change of Service

Changes may include modifications to the type of services offered, addition or removal of service categories, changes in operational location, or adjustments to service capacity. Only changes that fall within the regulatory framework and do not affect permit eligibility are considered.

Applicable Fees by Category

Permit modifications attract fees based on the nature and extent of the change. The Ministry publishes a fee schedule for different modification categories, which may include administrative charges, processing fees, or additional statutory levies. Companies must ensure timely payment to initiate the modification process.

Regulatory Approval Process

All changes require formal approval from NUPRC. Companies must submit a modification request through the OGISP portal, including supporting documentation, justification for the change, and any relevant updated corporate or operational records. The request is reviewed to ensure compliance with statutory, technical, and safety standards before approval.

Limitations on Post-Submission Changes

Changes cannot be made after permit issuance without formal approval. Any unauthorised modifications, such as providing unapproved services or extending operational scope beyond the permit, are considered regulatory breaches. Companies must wait for official approval before implementing changes to remain compliant.

GUIDELINES AND REQUIREMENTS FOR THE GRANT OF OIL AND GAS INDUSTRY SERVICE PERMITS (OGISP)

ISSUED BY: NIGERIAN UPSTREAM PETROLEUM REGULATORY COMMISSION 2023

Compliance, Sanctions, and Enforcement

Compliance with Oil and Gas Industry Service Permit (OGISP) conditions is critical to maintain operational legitimacy and regulatory trust. Non-compliance attracts sanctions, administrative penalties, and enforcement actions to protect safety, environmental, and operational standards in the upstream petroleum sector.

Grounds for Permit Suspension or Revocation

Permits may be suspended or revoked for:

  • Submission of false or misleading documents
  • Non-compliance with technical, safety, or environmental regulations
  • Operating beyond the approved scope of services
  • Failure to meet accreditation, certification, or reporting obligations

Administrative Penalties

Regulatory authorities may impose fines or other administrative penalties on companies that breach permit conditions. Penalties are intended to encourage corrective action, deter repeat offences, and reinforce adherence to statutory and regulatory requirements.

Blacklisting and Account Deactivation

Serious or repeated non-compliance can result in blacklisting, preventing the company from obtaining future permits. The company’s account on the OGISP portal may also be deactivated, restricting access to application and reporting systems until compliance issues are resolved.

Reactivation Conditions and Compliance Testing

Blacklisted or suspended companies may seek reactivation by addressing all compliance gaps, submitting corrective documentation, and undergoing compliance testing or audits. NUPRC evaluates whether the company meets regulatory standards before restoring permit validity or portal access, ensuring sustained operational integrity.

Review and Amendment of Guidelines

The regulatory framework for Oil and Gas Industry Service Permits (OGISP) is subject to periodic review and amendment to reflect changes in industry practices, safety standards, and statutory requirements. Companies must remain aware of updates to ensure ongoing compliance.

NUPRC’s Discretionary Review Powers

The Nigerian Upstream Petroleum Regulatory Commission (NUPRC) has the authority to review, update, and amend OGISP guidelines at its discretion. This allows the Commission to respond to evolving industry conditions, regulatory developments, and emerging operational risks.

Notice and Implementation of Amendments

NUPRC provides formal notice of guideline amendments through official channels, including the OGISP portal, circulars, and public announcements. Companies are expected to implement the changes within the stipulated timelines and ensure that their operations, applications, and reporting align with the revised requirements.

Transitional Compliance Expectations

When guidelines are amended, companies may be granted transitional periods to align existing permits and operations with the new requirements. During this period, companies must demonstrate active compliance efforts and provide evidence of steps taken to meet the updated standards. Failure to adhere to transitional expectations may result in sanctions or permit adjustments.

Practical Compliance Guidance

To ensure smooth processing of Oil and Gas Industry Service Permit (OGISP) applications and ongoing regulatory compliance, companies should adopt structured practices and proactive management strategies.

Common Application Errors

Frequent mistakes include incomplete submissions, mismatched corporate documents, inaccurate technical descriptions, and missing accreditation or certification evidence. Avoiding these errors requires careful review, cross-checking with statutory requirements, and adherence to portal guidelines.

Permit Category Selection Tips

Selecting the correct permit category is critical. Companies should align their application with the actual services offered, risk profile, and technical capacity. Misclassification can lead to delays, rejections, or regulatory scrutiny.

Documentation Readiness Checklist

Maintain a comprehensive checklist of required documents, including corporate registration, board resolutions, tax compliance evidence, technical certifications, and sector-specific approvals. Pre-verifying documents before submission ensures completeness and reduces resubmission risks.

Managing Multi-Service Applications

Companies offering multiple services should clearly define each service, supporting documentation, and applicable service group. Where necessary, submit separate applications or requests for modification to ensure that each service is properly authorised and monitored.

Maintaining Permit Validity

To maintain valid OGISPs, companies must:

  • Submit renewals on time
  • Comply with reporting and accreditation obligations
  • Implement changes only after regulatory approval
  • Monitor expiry dates and prepare timely submissions for extensions or updates

Adopting these practical measures helps companies minimise delays, maintain regulatory good standing, and ensure uninterrupted operations in the upstream petroleum sector.

Frequently Asked Questions (FAQs) – Oil and Gas Industry Service Permit (OGISP)

  1. What is an OGISP?

An Oil and Gas Industry Service Permit (OGISP) is a regulatory approval issued by the Nigerian Upstream Petroleum Regulatory Commission (NUPRC) that authorises companies to provide goods or services to upstream petroleum operators in Nigeria.

  1. Who needs an OGISP?

Any company, Nigerian or foreign, intending to provide technical, operational, or support services to upstream oil and gas operators must obtain an OGISP before commencing operations.

  1. How long is an OGISP valid?

OGISPs are typically valid for one year from the date of issuance. Renewals are required for continued operations. Certain permits may qualify for Permanent Until Reviewed (PUR) status, subject to periodic compliance assessment.

  1. What are the categories of OGISPs?

OGISPs are classified into General, Major, and Specialised categories, based on the nature, technical complexity, and risk profile of the services offered. Each category has specific eligibility, documentation, and compliance requirements.

  1. Can I change my service scope after permit issuance?

Yes, but changes require formal approval from NUPRC. Any unauthorised change in service scope is considered a regulatory breach and may lead to sanctions or permit revocation.

  1. What documents are required for an OGISP application?

Mandatory documents include CAC registration certificates, board resolutions, company profile, tax compliance evidence, technical certifications, and sector-specific licences or approvals, depending on the services provided.

  1. Are there fees for applying for or renewing an OGISP?

Yes. Application and renewal fees vary by permit category and service type. Payments are made through authorised channels, and all fees are non-refundable.

  1. What happens if a company fails to comply with OGISP requirements?

Non-compliance can lead to suspension, revocation, blacklisting, administrative penalties, and deactivation of portal accounts. Companies may be required to undergo corrective actions and compliance audits for reactivation.

  1. Are foreign companies treated differently from Nigerian companies?

Foreign companies must comply with local incorporation or registration requirements, provide evidence of technical and financial capacity, and meet all regulatory obligations applicable to Nigerian service providers.

  1. How can companies maintain permit validity?

Companies should submit timely renewals, comply with reporting obligations, maintain accreditation and certifications, and implement any approved changes through the regulatory process. Regular monitoring and proactive compliance are key to uninterrupted operations.

  1. Where can applications be submitted?

All OGISP applications, renewals, and modifications are submitted through the official NUPRC OGISP online portal. Companies must maintain accurate profiles and ensure all documents meet the portal’s upload requirements.

  1. Are there sector-specific requirements?

Yes. Certain services, such as drone operations, aviation, offshore drilling, or environmental management, require additional regulatory approvals from agencies like NCAA, ONSA, or other relevant authorities.
